According to the E-Sign Act, an "I Agree" button or an image of a handwritten signature is NOT sufficient. Neither provides authentication, ensures the contents have not been changed after the fact, and neither allows all parties to have their own proof that a given document was signed or not.
While a digitized signature (image) may look familiar, it increases the likelihood of fraud while it lacks the tamper-resistant power of digital signatures and the legal recognition of electronic signatures.
